Red Bull GmbH (the Austrian company that sells the drink) has just settled a class action lawsuit for false advertising filed in 2013.
Benjamin Careathers, a frequent Red Bull drinker, claimed that after drinking Red Bull regularly for 10 year, he neither sprouted wings nor experienced a boost in his mental or physical faculties.
And the judge bought it. As a result, the company is shelling out $13 million to its consumers.
The case hinged on the fact that, according to multiple sources, energy drinks like Red Bull give you a boost because they contain caffeine and not because of other ingredients, like the much touted guarana.
The suit claimed that: "Such deceptive conduct and practices mean that (Red Bull's) advertising and marketing is not just 'puffery,' but is instead deceptive and fraudulent and is therefore actionable."
Anyone who purchased Red Bull since 2002 is entitled to a $10 payout. No proof of purchase necessary.
Just go to this website and fill out the claim form by March 2, 2015.
You can also e-mail your claim to [email protected], fax it to 844-553-1373, or submit it via snail mail at the following address: Energy Drink Settlement, c/o GCG, P.O. Box 35123, Seattle, WA 98124-5123. In all cases, put it to the attention of Class Action Settlement Administrator, and make sure you file it by March 2, 2015.*
You're welcome.
*OK there is one catch: once the $13 million limit is reached, the company will have to divide the payout into smaller amounts to cover everyong. But it's still worth a shot.
